Conference topic: [T]o what extent are transitional justice and democracy mutually reinforcing? How can this and further questions be analyzed from a political science perspective? Are there tensions between some transitional justice concepts and democratic principles? Are established and emerging democracies well-equipped to deal with their past? Which of the various accepted transitional justice processes are most relevant and effective in transitioning to democracy in general and in specific contexts? Which processes are more suitable for the needs of conflicted democracies, or for democracies addressing their pasts? What role can democracy play in addressing continued post-transition injustices towards particularly vulnerable groups, such as ethnic minorities, women and children? Which elements of transitional justice are best enshrined in democratic constitutional law? What roles can civil society play in conflicted democracies and in transitions to democracy? What can democracies learn from authoritarian transitions? What ought not to be imported from the experience of authoritarian transition contexts?

It will address the complex and increasingly significant topic of the interplay between two distinct legal regimes: the conduct of hostilities regime, derived from [international humanitarian law] and the law enforcement regime, derived mainly from human rights law.

Researchers interested in addressing these and other questions related to the conference topic are invited to respond to this call for papers with a 1-2 page proposal for an article and presentation, along with a brief CV. Over the past few years, a series of political scandals have raised the ‘new constitutional question’. Multinational corporations violated human rights; private intermediaries in the internet threatened freedom of opinion, and recently, with particular impact, the global capital markets unleashed catastrophic risks – all of these pose constitutional problems in the strict sense. It is outside the limits of the nation-state in transnational politics and, at the same time, outside institutionalized politics, in the ‘private’ sectors of global society that these constitutional problems arise.

In the conference, social scientists and lawyers will discuss the question whether Constitutionalism has the potential to counteract the expansionist tendencies of social systems outside the state, particularly the globalized economy, science and technology, and the information media, when they endanger individual or institutional autonomy.

High-ranking speakers inform and debate on the current trends in European and International Competition Law. The Forum is the annual meeting point for about 180 participants from advocacy, the business world, academia as well as public authorities. The two-day event distinguishes itself from other competition conferences not only by its quality and its reputation, but also by the “je ne sais quoi” of its supporting programme.
